8415994 Canada Inc. operating as Art of Where ("Art of Where") values its customers and respects their privacy.

By using the www.artofwhere.com website, creating products in our Design Labs, and/or making online purchases of products, you agree to the terms and conditions of Art of Where’s Policy. If our Policy changes in the future, we will notify our customers and website users of any such changes by posting an updated Policy on our website.

Following the posting of such changes, your continued use of the www.artofwhere.com website will constitute your acceptance of these changes and you will be bound by such changes. If you do not continue to use the www.artofwhere.com website following a change to our Policy but take no other action with respect to your personal information, our use of that information will remain subject to our Policy as it was in effect prior to the change. You are responsible for regularly reviewing this Policy and any changes thereto.

WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store or create an account with us, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. If you visit our website on a mobile device, we will in addition receive data as to what type of device you are using.

Email marketing : With your permission, we may send you emails about our store, new products and other updates. You can opt in or out of email marketing in your account or at the bottom of the email by clicking “unsubscribe”.

Art of Where may use your personal information to:

  1. Process your order and to answer questions about the status of your order.
  2. Send you or your customers (via our drop shipping service) products that you have ordered.
  3. Maintain contact with you and provide you with ongoing personalized service.
  4. Communicate with you (via e-mail, post or otherwise) and provide you with promotional materials and additional information regarding our products, services, surveys, contests, promotions and special offers.
  5. Help us learn more about your usage of our website.
  6. Conduct marketing and performance research, to assist us in measuring our customer service, improve our customer experiences and product offerings.

CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. You can unsubscribe from our email marketing at any time in your account settings or by clicking unsubscribe at the bottom of one of our newsletters.

By posting items to the public Art of Where Artist stores online you are consenting to the sale of your artwork printed products. You can edit any products availability and visibility from your account. You must have an account to save designs and open a public store. You can also add information to your public profile like a profile picture, links, and written information. You may edit or remove this information at anytime from your account without our permission.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at:

You also may unsubscribe from our mailing list at any point by clicking the appropriate link at the bottom of the email.

You can add/remove products from your account or choose to remove your integration with an ecommerce platform at any point.

You can update all basic account information in the settings area of your account.

You can add or remove credit cards (the credit card numbers are never stored on our servers) or saved addresses from your account at any time.

You can deactivate your artist store at any time without telling us in advance. Email us at [email protected] or [email protected] to close your account and it will be done promptly, usually within 1-5 days. We will keep only what is necessary legally for government records/accounting. Products associated with your account will be removed from our servers within 30 days of the account being deleted.

DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Facebook & Google Sign-ups for quicker account creation: We seek permission to receive only your name and email address from them.
Big Cartel, Shopify, WooCommerce, Etsy: Integrations and automatic order processing.
Gmail and Kayako: Customer service and email management.
Paypal and Stripe: Payment processing.
Postal shipping software and apis: To automate shipping with various carriers.
Hosting Services: Various 3rd party providers for our hosting and web security processes.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you enter a credit card number into a text box on our website, the information is sent over an encrypted connection using secure socket layer technology (SSL) . We work with 2 payment processors; Stripe and Paypal. These services have their own security in place. Your payment information never reaches our servers and therefore is never stored anywhere on Art of Where. When you save a credit card for automatic payments, we save a token provided by our payment processors instead of the actual payment information. That token allows for repeated transactions while keeping confidential the payment information.

We encrypt all connections when possible with 3rd parties using the HTTPS protocol, including connection with integrated ecommerce platforms.

COOKIES

Here is a list of cookies that we use. We’ve listed them here so you can choose if you want to opt-out of cookies.

aow-session-id: This cookie keeps track of your current session on Art of Where.

keepAlive: This cookie will keep your session on Art of Where logged in after you close the window so you do not have to login again.

welcome-dialog: This cookie detects if this is your first time launching the design lab. If it detects you are a new user, you will see the intro walkthrough in the lab.

Third-party services that we integrate with including Facebook, Google, Stripe, Paypal and others may use cookies. You can find out more about these on their respective websites.

How long is personal information retained?

We will keep your personal information only as long as is reasonably necessary for the purposes described in this Policy or such longer period as may be required by applicable law. We retain all invoices in order to comply with government audits.

AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
