Art of Where est un fabricant sur demande de produit imprimés personnalisés. Nous imprimons des produits sur commande, avec des designs soumis par des gens du monde entier. Nous imprimons sur du tissu, des étuis en polymère, du bois, et d’autres matériaux, et nous proposons des services de drop ship et de vente en gros. Chacun de nos produits est fait à la main, et de légères variations peuvent survenir dans une même commande, ou d’une commande à l’autre. Nous travaillons constamment à minimiser ces différences afin que nos produits soient imprimés le plus précisément possible, à chaque fois.

Accès aux services

Pour pouvoir avoir accès à nos services de drop ship, vous devez créer un compte chez nous et accepter nos conditions générales. Vous pouvez commander des produits sans posséder de compte, mais dans ce cas, votre consentement aux conditions générales est implicite et s’applique à toutes les commandes. Les produits ne peuvent pas être enregistrés si vous n’avez pas de compte chez nous.

Variations d’impression

Dans notre industrie, des variations d’impression peuvent survenir quand des designs sont imprimés sur des surfaces et tissus variés.

Les variations pouvant être présentes dans une même commande ou d’une commande à l’autre incluent entre autres:

  1. Le placement de l’image sur le produit. Le placement de votre image sur le produit peut varier d’une pièce à l’autre. Certaines variations sont très légères, tandis que d’autres se remarquent davantage.
  2. Les différences entre le produit conçu en ligne avec l’outil Design Lab et le produit final, qui peuvent arriver. Le Design Lab donne un aperçu approximatif du produit final. Pour les articles vestimentaires, la conception est faite sur une taille LARGE dans le Design Lab. Lorsque nous générons les autres tailles, le placement du design est différent. Tenez compte des zones de sécurité du texte indiquées dans le Design Lab afin de ne perdre aucun détail important de votre design. Pour toute inquiétude relative au placement de l’image, n’hésitez pas à nous contacter.
  3. Les couleurs finales de votre produit imprimé différeront de votre design pour de nombreuses raisons, incluant les suivantes:
    1. Différences d’écran. Tous les écrans ont une représentation des couleurs qui peut varier. Il nous est impossible de contrôler les réglages de votre écran.
    2. Les limites de la gamme de couleurs de nos imprimantes. Nos processus d’impression peuvent reproduire différentes gammes de couleurs. Grâce à un logiciel, nous traduisons votre design en des couleurs incluses dans les gammes de nos imprimantes. Les couleurs de votre design qui ne sont pas dans la gamme de couleurs possibles sont remplacées par la couleur la plus proche possible. Le fluo, par exemple, n’est pas imprimable par nos systèmes.
    3. Nous proposons une large gamme de tissus sur lesquels imprimer. Chaque tissu a un rendu différent après impression, même lorsqu’ils sont soumis au même procédé d’impression. Certains tissus absorbent l’encre rapidement, tandis que d’autres sont plus denses. Les tissus ont tous une teinte de blanc différente. C’est ce genre de détails qui peut causer des variations dans les couleurs du produit fini.
    4. La qualité du design soumis. Les fichiers de mauvaise qualité ne s’imprimeront pas aussi bien que les images à haute résolution. Veuillez suivre nos instructions de design lorsque vous créez vos fichiers d’impression.
    5. L’espace couleurs. Nous demandons des images en RGB. Les images avec d’autres espaces couleurs ressortiront différemment lors de l’impression. Nos Design Labs tentent de reproduire les couleurs du fichier, donc s’il est au format CMYK, les couleurs seront incorrectes dans le Design lab.
  4. Art of Where a un système d’impression automatisé. Cela signifie que tous les fichiers image sont envoyés directement à notre système d’impression. Nous ne vérifions pas la qualité du fichier, y compris la pixellisation, avant l’impression. Veuillez consulter nos instructions de design en préparant votre design, et assurez-vous d’avoir le bon espace couleurs ainsi que le bon format. Nous ne pouvons pas réimprimer des articles à cause d’un design de mauvaise qualité ou un fichier non adapté.
  5. Des petites bavures ou dédoublements peuvent survenir quand des zones claires sont collées à des zones sombres. C’est ce qui arrive quand par exemple les couleurs sombrent déteignent légèrement sur les couleurs claires. Il est normal que certaines situations d’impression donnent ce résultat.

Imperfections des coutures

Occasionnellement, un produit peut présenter un défaut de couture, comme un trou, du tissu abîmé ou des coutures mal faites. Un défaut de couture est une imperfection qui rend le produit inutilisable (et difficile à porter). Merci de nous informer de tout défaut, comme précisé ci-dessous.

Défauts sur les produits sans tissu

Nous avons une large gamme de produits imprimés en plus de nos vêtements. Si vous recevez un produit qui comporte un défaut mécanique (pas un défaut de couleur d’impression), merci de nous en informer comme indiqué ci-dessous.

Comment nous informer d’un défaut

  • Contactez-nous avec des photos détaillées du souci et votre numéro de commande.
  • Nous essaierons de vous répondre dans les 48 heures. Nous aurons peut-être besoin de plus d’informations.
  • Tous les problèmes seront évalués au cas par cas en utilisant les informations fournies.

Remboursements

Les produits imprimés sur mesure ne sont pas remboursables. Les produits comportant des problèmes mécaniques ou des défauts sont habituellement réimprimés et remplacés. Merci de nous faire part de vos inquiétudes et nous traiterons chaque problème au cas par cas.

Commandes en drop Ship et service client

Lorsque Art of Where remplit une commande en drop ship, nous fournissons à notre client (la personne qui paye le produit) un produit fini expédié directement à la personne concernée (la personne qui va utiliser le produit). Nous demandons à nos clients d’entretenir leurs relations avec leurs clients autant que possible. Par exemple, en fournissant des informations détaillées au bon moment à leurs clients. Si l’un des clients a un problème avec le produit reçu, voici le processus de résolution, en 4 étapes:

  1. Demandez des photos transférables à votre client pour illustrer le problème.
  2. Évaluez l’étendue des dégâts, et si ce problème rentre dans la catégorie de nos variations acceptables au niveau des couleurs et du placement de l’image sur le produit. Si c’est le cas, expliquez à votre client les limites de l’impression sur mesure.
  3. Si le problème n’entre pas dans la catégorie des limites de l’impression, contactez-nous en incluant le numéro de commande et les photos du problème fournies par votre client.
  4. Nous évaluerons les problèmes, et il nous faudra alors peut-être des informations supplémentaires. Nous ferons de notre mieux pour tenter de vous répondre dans les 48 heures suivant la réception de votre e-mail.

Frais de douane, taxes et retards de livraison

Art of Where expédie dans le monde entier avec Canada Post, USPS, et d’autres services de livraison variés. Des numéros de suivis seront fournis pour les commandes à chaque fois que c’est possible. Tous les coûts supplémentaires ou frais de douanes provenant des expéditions (locales et internationales) ne sont pas de la responsabilité d’ Art of Where. Les commandes internationales de moins de 100 $ ne comportent pas d’option de suivi.

Veuillez contacter votre bureau de poste local si vous n’êtes pas au courant des frais de douanes, taxes et temps de transit de votre pays.

Art of Where permet à ses clients de demander des méthodes d’expédition alternatives et express, comme UPS ou DHL, pour un prix additionnel. Merci de nous contacter si vous souhaitez utiliser une méthode d’expédition améliorée pour votre commande, et nous mettrons ça en place si c’est possible.

Nous ne contrôlons pas les envois retardés par le service d’expédition, et les coûts qui résultent d’expéditions tardives ne sont pas de la responsabilité d’Art of Where. Nous nous engageons à expédier votre commande au moment opportun et faire de notre mieux pour respecter nos temps de production estimés. De temps en temps, une commande prend plus longtemps que prévu à cause de raisons variées, comme une réimpression, un inventaire bas, un tissu plus en stock ou des problèmes techniques. Droits d’auteur, reproduction et photographies

Tous les designs apparaissant sur Art of Where restent la propriété de l’artiste qui les a créés et téléchargés. En téléchargeant des designs sur notre site web, vous donnez le droit à Art of Where de reproduire ces œuvres. Nous imprimons le design et créons le produit pour le représenter, dans notre Design Lab. Si un artiste supprime les produits conçus sur Art of Where, nous ne produirons plus les produits supprimés. Nous ne pouvons pas garantir que les images ou aperçus des œuvres supprimées ne continueront pas à apparaître en ligne après suppression des liens associés de notre côté (ex. recherche Google image).

Les fichiers sont stockés sur des serveurs protégés, et ne sont accessibles qu’avec des connexions cryptées et sécurisées. Pour la production, les fichiers sont transférés sur un serveur local de façon temporaire, afin de pouvoir les transmettre aux imprimantes. Une fois l’article expédié, les fichiers sont supprimés.

Art of Where se réserve le droit de produire et photographier les produits présents dans les magasins d’artistes Art of Where à des fins promotionnelles, sans en informer l’artiste. Ces photos peuvent être utilisées sur notre site web, nos réseaux sociaux, dans des vidéos, et des sites web de tierce partie. Art of Where mentionnera les artistes impliqués si c’est possible. Si un produit présent sur une photo est supprimée par l’artiste après la publication des photos, nous n’avons pas l’obligation de supprimer les photos. Seuls les produits qui apparaissent dans les magasins d’artistes (disponibles au public) peuvent être photographiés.

De temps en temps, nous prenons des photos de notre studio de production. Ces photos incluent des parties de produits non terminés, avec des designs imprimés. Nous nous réservons le droit de publier ces photos sur notre site web et réseaux sociaux sans implication, et sans demande de consentement préalable.

Produits avec défaut, et mauvaises impressions

Parfois, nous avons des produits mal imprimés, qui ne passent pas nos contrôles de qualité. Pour réduire notre impact sur l’environnement, nous donnons les produits imparfaits aux refuges, écoles, réserves et crèches. Nous ne donnons jamais les produits à des institutions qui les vendent, et nous précisons aux destinataires que ces produits ne doivent jamais être revendus.

Art of Where is an expansive website including online product Design Labs, public artist product stores, a blog, integrations with Ecommerce platforms as well as being a physical manufacturing and production studio. We give our member artists and individuals the ability to create unique products printed with artwork. The foundation of our community is respect for artwork and the creative process. Here are the rules we expect our community members to abide by when using our site:

  1. If you don't have the rights to it, please don't upload it. Only upload artwork that you have the right to reproduce.
  2. Uploading images that are offensive is not allowed in our community. Please do not upload images containing explicit sexual content, racist, homophobic, or other ignorant themes, or any images that contain disparaging remarks about other people or companies.
  3. Art of Where reserves the right to refuse to print/create products with images that violate our upload policies.
  4. Any issues (legal or otherwise) that arise from the creation of Art of Where products displaying your uploaded image you are 100% responsible for. Any images uploaded to create custom items with are the responsibility of the person who uploaded them. Art of Where is not liable for any damages due to copyright infringement or the use of restricted images on our products. Please examine your artwork carefully and know what you are uploading before using the Art of Where Design Labs to create products or before you post products to the online artist stores.
  5. You reserve all rights to your artwork. You may delete a product at any time. Art of Where does not gain any rights to your images when you upload them other than to reproduce on-demand the artwork for the intended product. We do reserve the right to produce and photograph products found in the public artist stores for posting on Art of Where and related social media sites.
  6. Art of Where reserves the right to remove product designs without notice from anywhere on the website that are in violation of our policies.

We make various services available on this site including, but not limited to, custom printed clothing, accessories, wall art and printed home decor products that are created by users through our interactive Design Labs. Users upload content that they have permission to use and create customized products. Users are entirely responsible for and retain rights to uploaded content, and other like services. You are responsible for providing, at your own expense, all equipment necessary to use the services, including a computer, modem, and Internet access (including payment of all fees associated with such access).
  2. We reserve the sole right to either modify or discontinue the site, including any of the site’s features, at any time with or without notice to you. We will not be liable to you or any third party should we exercise such right. Any new features that augment or enhance the then-current services on this site shall also be subject to these Terms of Use.
  3. We reserve the right to refuse service to anyone for any reason at any time.You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. You specifically represent that any Content is: (i) your original work, or it is properly licensed, and does not violate the copyright or any other personal or property right of any third party; and that (ii) you have obtained any and all releases and permissions necessary for submitting the Content. You retain your rights to any Content you submit, post or display on or through the Services. If it is determined that you have, at any time, violated any of the foregoing provisions, you may thereafter be barred from submitting or posting any further material using the Services, and we may pursue any remedies available under these Terms of Use or at law.
  3. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

  4. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Conduct on Site

  1. Your use of the site is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the site. When an artist deletes designs from their profile, this artwork is no longer available for production or graphic use by Art of Where. However, if we have photographed products appearing in the public stores that are subsequently deleted, we may not remove the photos displaying such products.

SELLER DISCLAIMS ANY WARRANTIES OF NON-INFRINGEMENT WITH RESPECT TO THE GOODS AND NONE OF SELLER OR ANY SELLER AFFILIATE SHALL HAVE ANY DUTY TO DEFEND, INDEMNIFY, OR HOLD HARMLESS BUYER FROM AND AGAINST ANY OR ALL DAMAGES OR COSTS INCURRED BY BUYER ARISING FROM THE INFRINGEMENT OF PATENTS OR TRADEMARKS OR VIOLATION OF COPYRIGHTS BY ANY OF THE GOODS.

Force Majeure

  1. Seller shall not be held responsible for any failure of performance to make timely delivery of all or any part of the Goods in the event such failure was due, in whole or in part, to federal, provincial or municipal action, statute, ordinance or regulation, strike or other labor trouble, fire or other damage to or destruction of, in whole or in part, the Goods or the manufacturing facility for the Goods, the lack of or inability to obtain raw materials, labor, fuel, electrical power, water or supplies, or any other cause, act of God, contingency or circumstances not subject to the reasonable control of Seller, which causes delays or hinders the manufacture or delivery of Goods. Seller shall determine in good faith the extent to which it can reasonably control a cause, contingency, or circumstance that affects the performance of its obligations.

General

  1. Buyer may not assign this Agreement without Seller's written consent. Seller is the sole intended beneficiary of this Agreement. If there is any inconsistency between this Agreement and any other agreement included with or relating to the Goods, this Agreement shall govern. This Agreement may not be modified, altered or amended without the written agreement of Seller. Any additional or altered terms attached to any order submitted by Buyer shall be null and void, unless expressly agreed to in writing by Seller. If any term of this Agreement is illegal or unenforceable, the legality and enforceability of the remaining provisions shall not be affected or impaired. This Agreement shall be interpreted under the laws of Canada, without giving effect to conflicts-of-law rules; and in the event of a dispute under this Agreement; Buyer submits to the exclusive jurisdiction and venue of the courts of Canada and hereby waives any objection to such jurisdiction and venue.

Refunds

  1. All custom printed products are non-refundable including artist store items, drop shipped products and custom designed items.

Language

  1. The parties hereto confirm that they have agreed that this Agreement and all documents relating hereto be drafted in English only.
